Guildford MP to Challenge Government on Expected Changes in Planning Law

Guildford MP Zöe Franklin (Lib Dem) is preparing to question the House of Commons over anticipated planning law reforms, following Berkley Homes’ decision to withdraw its long-standing scheme to refurbish Howard of Effingham School, in favour of housing development.

Developer Berkley Homes has abandoned its proposal to deliver a new school in Effingham after 12 years, citing a significant rise in construction costs, which it said made the scheme financially unviable.

In a public statement, Ms Franklin questioned the true motivations behind the decision, raising concerns on behalf of the school.

“I know the school believes Berkeley Homes have taken this decision, to pursue a housing-only development, by taking advantage of an expected change in planning law,” the Guildford MP said.

The reforms in question intend to scale back current Section 106 infrastructure agreements – the mechanism that requires developers to contribute to affordable housing, local infrastructure such as schools, and public green spaces.

The changes would likely reduce developer obligations and convert some green belt areas to “grey belt” land, making residential development more accessible and profitable.

Ms Franklin said that she would be “outraged” if it was proved that the developer had been influenced by the anticipated changes, and warns about the wider possible implications.

“If this is rooted in developers being able to take advantage of expected changes to planning law, I am outraged,” Ms Franklin said. “If this is the case, the implications will be felt across not just the Guildford constituency, but the whole country.”

Following a recent visit to the school, Ms Franklin described seeing the disappointment on the students’ faces as “heart-breaking”, adding that “this news is a huge let-down after 12 years of promises.”

While recognising that Howard of Effingham remains one of the best state secondary schools in the country, she expressed frustration at what had been a long-anticipated redevelopment.

Looking ahead, Ms Franklin has said that she is committed to working with the school and the community to “push a positive way forward.”

She confirmed plans to write to the Secretary of State for Housing, Communities and Local Government, asking for an explanation and clarity on the Government’s changes, as well as contacting the Secretary of State for Education to ask for her support and advice. She will also seek a formal response from Berkeley homes.

In addition, Ms Franklin plans to raise this issue on a national level at the House of Commons, to raise wider awareness and secure information and answers.
